This appeal requires that we decide whether, and under what circumstances, a district court may release the presentence investigation report of a criminal defendant to members of the news media. The district court authorized disclosure of the defendants presentence report under the "common law right of access to judicial records. See Nixon v. Warner Communications, Inc., 435 U.S. 589, 55 L. Ed. 2d 570, 98 S. Ct. 1306 (1978). The government appeals, arguing that the district court applied an incorrect legal standard in determining whether disclosure was appropriate. We vacate the district counts disclosure order and remand for reconsideration under the appropriate legal principles.
